Berman, the United States Attorney for the Southern District of New York, James P. O’Neill, the Commissioner of the New York City Police (“NYPD”), and George P. Beach II, the Superintendent of the New York State (NYSP), announced the arrest of Andrew (DOB: 8/9/1993; single; and unemployed) of 501 W. 169th Street, New York, NY on narcotics-related charges. The arrest is the result of an investigation conducted by the Bergen County Prosecutor’s the New York Drug Enforcement Task (NYDETF) comprising agents and officers of the U.S. Drug Enforcement Administration, the New York City Police Department and the New York State Police.
In May 2018, the NYDETF and the Bergen County Prosecutor’s Office received information that Andrew Herrera was involved in the distribution of narcotics. On May 8, 2018, during an undercover operation in Englewood, NJ, Herrera and an unidentified accomplice were observed and suspected to be in possession of a large amount of a controlled dangerous substance, namely Crystal Methamphetamine. An investigative motor vehicle stop was attempted, but Herrera fled the scene. During the ensuing police pursuit, Herrera struck multiple vehicles in Englewood and nearly ran over a law enforcement officer. As the pursuit continued onto Route 4 East, Herrera discarded what was later identified as two pounds of Crystal Methamphetamine from the vehicle. Andrew Herrera’s vehicle was eventually abandoned in Fort Lee, NJ. On Wednesday, May 9, 2018, the NYPD located and arrested Herrera. He is currently being held pending extradition to Bergen County.
As a result of the investigation, Herrera was charged with: one count of N.J.S.A. 2C:35-5B(8), Possession With Intent to Distribute A Controlled Dangerous Substance, namely Crystal Methamphetamine, a 1st degree crime; one count of N.J.S.A. 2C:29-2B, Eluding While Creating Risk Of Death Or Injury, a 2nd degree crime; one count of N.J.S.A. 2C:12-1B(1), Attempted Aggravated Assault On A Law Enforcement Officer, a 2nd degree crime; one count of N.J.S.A. 2C:29-2A(3)(A), Eluding, a 3rd degree crime; one count of N.J.S.A. 2C:29-3B(1), Hindering By Suppression Or Destruction Of Evidence, a 3rd degree crime; and one count of N.J.S.A. 2C:29-2A(2), Resisting Arrest By Flight, a 4th degree crime.
Acting Prosecutor Dennis Calo states that these charges are merely accusations and that the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt, and would like to thank the New York Drug Enforcement Task Force, the Englewood Police Department, the Hackensack Police Department, the Dumont Police Department, the Fort Lee Police Department, the Bergen County Regional SWAT, and the NYPD Manhattan North for their assistance in this investigation.
