EX-WASHINGTON REDSKIN AND SUPER BOWL RECORD HOLDER ARRESTED FOR SELLING COCAINE

Denver, CO -- Jeffrey D. Sweetin, Special Agent in Charge of the Drug Enforcement Administration (DEA) Rocky Mountain Division and Bill Leone, U.S. Attorney for the District of Colorado, announced today that Timmy Smith, age 41, of Denver, has been arrested for distributing cocaine in Denver, Colorado. Timmy Smith is a former NFL running back for the Washington Redskins who broke the NFL record for the most rushing yards in the 42-10 victory over the Denver Broncos on January 31, 1988. Arrested along with Timmy Smith was his brother, Chris Smith, age 35, of Lakewood, Colorado.

SAC Jeffrey D. Sweetin stated that, “This case shows the lure of easy money can attract both the downtrodden looking to make a better life and those who have been idolized and envied for living the American dream. Greed does not distinguish between rich, poor, notorious, and unknown. The Timmy Smith’s of the world are not immune from greed nor are they immune from being held accountable for contributing to the degradation of our communities. The insidious nature of drug trafficking corrupts everything and everyone it touches.”

In April of this year, the DEA Rocky Mountain Division initiated an investigation into the drug trafficking activities of Timmy Smith. Timmy Smith sold cocaine on seven occasions to undercover personnel at various locations in the Denver metro area. Timmy Smith is employed as a youth counselor and participated in several youth football camps this summer in the Denver area.

On Friday, September 30, 2005, Timmy Smith was arrested when he met a DEA undercover agent to sell ½ kilo of cocaine. Chris Smith was arrested in conjunction with the undercover meeting. Federal search warrants were served at two residences; one located at 7373 E. Iowa Avenue, #1114, Denver, Colorado, and the other at 895 S. Garrison, Lakewood, Colorado.

Including today’s enforcement action, a total of 1,300 grams of cocaine and approximately $100,000 in assets have been seized.

Timmy Smith and Chris Smith have been charged by complaint with conspiracy to possess with intent to distribute more than 500 grams of cocaine, in violation of United States Code 846 and 841 (a)(1) and (b)(1)(A)(iiii). If convicted, the defendant’s face not less than 10 years and no more than life imprisonment; $4,000,000 fine or both; no less than 5 years supervised release; and a $100 assessment fee. A Criminal Complaint is a probable cause charging document. Every defendant accused of committing a federal crime has a Constitutional right to be indicted by a federal grand jury. The charges are only allegations, and the defendants are presumed innocent unless or until proven guilty.
