BUFFALO, N.Y. –U.S. Attorney James P. Kennedy, Jr., and DEA New York Division Special Agent in Charge Ray Donovan announced that Tremaine Giddens, 42, of Buffalo, N.Y., pleaded guilty before Chief U.S. District Judge Frank P. Geraci, Jr., to possession with intent to distribute, and distribution of, cocaine and being a felon in possession of ammunition. The charges carry a maximum penalty of 30 years in prison and a $2,000,000 fine.

Assistant U.S. Attorney Laura A. Higgins, who is handling the case, stated that in October 2017, the defendant sold a quantity of cocaine to an individual working with the Drug Enforcement Administration in a commercial parking lot at 15 Skillen Street in Buffalo.

On Nov. 9, 2017, a federal search warrant was executed at 15 Skillen Street where investigators recovered a quantity of suspected cocaine, plastic bags, baking powder and 2 digital scales. In addition, 35 rounds of .44 caliber ammunition was recovered.

On Aug. 29, 2006, Giddens was convicted in federal court of possession with intent to distribute, and distribution of, a controlled substance. On Jan. 20, 2000, in Erie County court, the defendant was convicted of criminal possession of a controlled substance in the fifth degree. As a result of these convictions, Giddens is legally prohibited from possessing ammunition.

The plea is the result of an investigation by the Drug Enforcement Administration, Buffalo Resident Office.

Sentencing is scheduled for June 20, 2019, before Judge Geraci.
