SACRAMENTO, Calif. - A federal grand jury returned a superseding indictment yesterday, charging Mark Bowden, 33, of Penn Valley, with another count of possession of methamphetamine with intent to distribute, Acting Special Agent in Charge Bruce C. Balzano and United States Attorney Benjamin B. Wagner announced today.

This case is the product of an investigation by the Drug Enforcement Administration and the Nevada County Sheriff’s Department. Assistant United States Attorney Olusere Olowoyeye is prosecuting the case.

According to court documents, Bowden was charged in March 2013 with one count of possession of methamphetamine with intent to distribute for an incident that occurred on February 12, 2013. The superseding indictment adds another count of the same charge for events that occurred on April 3, 2013.

Bowden has been in federal custody since May 9, 2013.

If convicted, Bowden faces a statutory penalty of five to 40 years in prison and a fine of up to $5 million. Any sentence, however, would be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables. The charges are only allegations; the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
