Federal Jury Finds Tampa Pill Mill Pharmacist Guilty
TAMPA, Fla. - A.D. Wright, Acting Special Agent in Charge, Drug Enforcement (DEA), Miami Field Division, and A. Lee Bentley, III, United States Attorney announces that a federal jury has found Brian C. (56, Melbourne) guilty of conspiracy to distribute and dispense oxycodone outside the usual course of professional practice. Weiler, a pharmacist of 32 years, faces a maximum penalty of 20 years in federal prison and the forfeiture of his Florida Pharmacist License. His sentencing hearing is scheduled for March 13, 2015. Weiler was indicted in October 2011.
According to evidence presented at trial, from an unknown date through October 26, 2011, Weiler worked at two pharmacies, VIP Pharmacy on Martin Luther King, Jr. Boulevard; and New Tampa Pharmacy on Waters Avenue. During that time, he filled hundreds of prescriptions for very large doses of oxycodone. The recipients included drug addicts and members of doctor shopping organizations who traveled from Ohio, Kentucky, and Tennessee. During the course of the conspiracy, Weiler dispensed more than 100,000 pills from the two pharmacies. Owners and operators of the VIP Pharmacy and New Tampa Pharmacy have previously been convicted of federal conspiracy charges.
This case was investigated by the DEA Tampa District Office, the Pasco County Sheriff's Office, and the Temple Terrace Police Department. It is being prosecuted by United States Attorney’s Office for the Middle District of Florida.
