Kentucky Woman Sentenced To 27 Years Federal Prison For Illegally Providing Rx Drugs

Judy McIntosh provided Rx drugs to woman who died of overdose

LONDON, Ky. - A Jackson, Ky., woman who illegally provided prescription drugs to a woman who died of an overdose was sentenced to 327 months in federal prison by U.S. District Judge Gregory F. Van Tatenhove.

This marks the first federal sentence in the Eastern District of Kentucky for a defendant that caused a death by distributing prescription medication. The Eastern District of Kentucky consists of 67 counties stretching from southern Kentucky to the Ohio border.

According to court records, on October 2, 2010, a 19 year-old woman received a quantity of Oxycodone pills from 48-year-old Judy McIntosh, consumed the pills, and later died at McIntosh’s home. The medical examiner’s report confirmed the cause of death was from an Oxycodone overdose.

Information at the sentencing hearing revealed that following the woman’s death, McIntosh continued trafficking pills and used two minors to facilitate her drug trafficking.

McIntosh pleaded guilty in March to distribution of Oxycodone resulting in death. She also pleaded guilty to a conspiracy charge.

McIntosh also admitted that between August 2010 and June 2011 she conspired with others to distribute Oxycodone in Lee and Breathitt Counties, Kentucky.

Kerry B. Harvey, U.S. Attorney for the Eastern District of Kentucky, Robert L. Corso, Special Agent in Charge of the U.S. Drug Enforcement (DEA) and Karen Kelley, President of Operation UNITE jointly made the announcement.

The investigation was conducted by the DEA and Operation UNITE. The U.S. Attorney’s Office was represented by Assistant United States Attorney Jason D. Parman.
