Malden
Detective and Two Others Charged with Participating in Cocaine Conspiracy

federal grand jury returned an indictment late yesterday charging a
Detective with the Malden Police Department and two other men with
conspiring to distribute approximately three kilograms of cocaine.
Mark R. Trouville, Special Agent in Charge of the U. S. Drug Enforcement
Administration in New England and United States Attorney Michael J. Sullivan,
announced that DAVID JORDAN, age 43, of 123 Spring Street in Stoneham,
Massachusetts, ANTHONY BUCCI, age 41, of 6 Maple Road in North Reading,
Massachusetts, and FRANCIS MUOLO, age 39, of 11 Marble Street in Stoneham,
Massachusetts, were charged in an indictment with conspiracy to distribute
and to possess with intent to distribute approximately three kilograms
of cocaine; possession with intent to distribute approximately three
kilograms of cocaine; and using or carrying a firearm during and in relation
to a drug trafficking crime. BUCCI is also charged separately with one
count of possession of 91 grams of cocaine with intent to distribute.
In addition, JORDAN is charged with witness tampering and three counts
of making false statements to the DEA. The three defendants were arrested
on May 20, 2004 by criminal Complaint in connection with this matter.
According to the
indictment and documents filed previously with the Court, it is alleged
that on December 24, 2003, BUCCI, MUOLO, and JORDAN conspired
to steal three kilograms of cocaine from a scheduled drug deal. It
is alleged that arrangements were made by an individual, Jon Minotti,
for
a supplier to bring three kilograms of cocaine to a meeting at the
Malden Medical Center parking lot where BUCCI was to purchase the cocaine.
It
is alleged that shortly after the supplier arrived with the cocaine,
JORDAN, a Detective with the Malden Police Department, arrived on the
scene, blocking the supplier’s vehicle with his own. It is alleged
that
JORDAN identified
himself as a police officer and that Minotti fled into nearby woods
with the three kilograms of cocaine It is alleged
that JORDAN
then allowed the supplier and BUCCI to leave the scene. It is alleged
that, as had been previously arranged, MUOLO, who had been waiting
in his car on the other side of the nearby woods, picked up Minotti
after
he had run through the woods with the cocaine.
At the time, DEA
agents were involved in a separate drug investigation and had a wiretap
on the drug supplier’s telephone. As part of
that investigation, the DEA agents were surveilling the supplier and
observed the incident. Shortly after, the DEA began an investigation
of JORDAN and his associates. It is alleged that after JORDAN became
aware that law enforcement agents were investigating the drug supplier
from
whom the cocaine had been stolen,
JORDAN spoke with
DEA agents on several occasions attempting to find out the status of
the investigation. It is also alleged that
JORDAN
made false statements to the Drug Enforcement Administration
about his involvement
in the events that transpired in the Malden Medical Center parking
lot on December 24, 2003.
On June 22, 2004,
JORDAN and MUOLO were released pending trial by U. S. Magistrate Judge
Joyce London Alexander. BUCCI has been
ordered
to remain in federal custody.
If convicted, each
defendant faces a mandatory minimum of 5 years’ imprisonment
and a maximum of 40 years’ imprisonment on both the conspiracy
to distribute three kilograms of cocaine count and the distribution of
three kilograms of cocaine count. The using or carrying a firearm during
and in relation to a drug trafficking crime count carries a mandatory
minimum of 5 years in prison up to life for each defendant. If convicted
of the possession of 91 grams of cocaine with intent to distribute charge,
BUCCI also faces a maximum of 20 years in prison. Lastly, JORDAN also
faces a maximum sentence of 10 years in prison on the witness tampering
charge and 5 years in prison on each of the three false statement charges.
The investigation
is continuing. The case is being investigated by the U. S. Drug Enforcement
Administration and the Massachusetts
State
Police
(including the Middlesex County District Attorney’s Narcotics Unit),
with the assistance of the U. S. Marshals Service, the Bureau of Alcohol,
Tobacco, Firearms, and Explosives, and the Stoneham, Everett, and Malden
Police Departments. It is being prosecuted by Assistant U. S. Attorney
John J. Farley in Sullivan’s Public Corruption and Special Prosecutions
Unit.
