Sentenced to 15 Years in Federal Prison
Health Care Provider Found Guilty of Dispensing
Oxycontin without a Legitimate Medical Purpose

Chicago Special Agent in Charge Gary Olenkiewicz announced that Dr.
David Demaret Chube II was sentenced in the Northern District of Indiana
to fifteen years and 8 months in a federal prison for violating the
Controlled Substances Act. The sentence is the result of his conviction
May 1, 2006, on a six count indictment charging Chube with four counts
of dispensing controlled substances (oxycotin) without a legitimate
medical purpose in violation of Title 21 USC Section 841 (A)(1); and
two counts for health care fraud in violation of Title 18, USC Sections
1347 and 2. Chube is also facing a $60,000 fine to be paid directly
to the District Court. His brother and business partner, Dr. Charles
Randall Chube, was also sentenced for dispensing controlled substances
without a legitimate medical purpose.
“This sentencing
sends a message to the medical community that they are not untouchable
when they prescribe narcotics for no legitimate reason,” Olenkiewicz
said. This investigation was successful due to the combined efforts
between the DEA, FBI, FDA, and the Indiana Attorney General’s
Medical Fraud Control Unit. We will continue to work with our partners
in the law enforcement community to keep rogue doctors from harming
our citizens.”
The investigation
involved the doctors selling oxycotin to patients from southwest Michigan
and Indiana who then distributed it in the Gary, Indiana area. The
case was prosecuted by the United States Attorney’s office in
Hammond, Indiana.
