Trio
Indicted on Drug Charges
Boston,
MA...Three Boston men were indicted in federal court on Wednesday,
October 11, 2006, on drug charges in connection with the sale of methamphetamine
to undercover officers.

W. Stansbury, Special Agent in Charge of the U.S. Drug Enforcement
Administration in New England; United States Attorney Michael J . Sullivan;
and Colonel Mark Delaney, Superintendent of the Massachusetts State
Police, announced that DAMIEN SMITH, age 27, of 60 Charles Gate
East, Boston, ANTONIO FORTUNY, age 49, of 260 North Harvard
Street, Brighton, and DOUGLAS E. TRIBLEY III, age 28, of 260
North Harvard Street, Brighton, were charged in a four-count Indictment
with conspiracy to possess with intent to distribute, and distribution
of, methamphetamine, and possession with intent to distribute, and
distribution of, methamphetamine.
According
to the Indictment, criminal Complaint and other documents previously
filed with the Court, the charges against SMITH, FORTUNY and TRIBLEY stem
from three sales of methamphetamine to two undercover officers. Specifically,
it is alleged that between August 8, 2006, and August 10, 2006, SMITH,
FORTUNY and TRIBLEY, conspired to possess and distribute methamphetamine
to two undercover Massachusetts State Troopers that had been assigned
to the DEA's High Intensity Drug Trafficking Area ("HIDTA")
Task Force located in Worcester. It is alleged that, on August 10,
2006, SMITH, FORTUNY and TRIBLEY sold an ounce of methamphetamine
in exchange for $2,000 to the two undercover officers while inside FORTUNY and TRIBLEY's apartment,
located at 260 North Harvard Street in Brighton. It is further alleged
that on August 22, 2006, FORTUNY sold a small amount of methamphetamine
in exchange for $150 to the same undercover officers while inside his
residence. Lastly it is alleged that on August 25, 2006, SMITH sold
methamphetamine in exchange for $300 to the same undercover officers.
SMITH,
FORTUNY and TRIBLEY were arrested in connection with the charges
on September 21, 2006, and are presently in federal custody pending
trial. All three defendants are expected to be arraigned before U.S.
Magistrate Judge Judith Gail Dein on October 18, 2006.
If
convicted, SMITH, FORTUNY and TRIBLEY each face a maximum sentence
of 20 years' imprisonment, to be followed by 3 years of supervised
release, and a $1 million fine.
The
case is being investigated by the U.S. Drug Enforcement Administration's
HIDTA Task Force and the Massachusetts State Police. |
