Prescription Fraud Violator Sentenced to Four Years In California State Prison

APR 25 -- (San Diego, CA)- On April 24, 2008, Dewey Gordon was sentenced to four years custody in California State Prison and ordered to pay a $1,000.00 fine and a $1,000.00 restitution fund fine. This sentence is the stems from the August 27, 2007, arrest of Gordon by the Drug Enforcement Administration and San Diego County Probation Department for controlled substance prescription fraud violations. At the time of Gordon’s arrest, Gordon was on formal probation in California for three prior felony convictions and a felony conviction in the State of Colorado for fraudulently obtaining controlled substances utilizing various aliases.

On November 16, 2007, Gordon pleaded guilty to seven counts in violation of California Health and Safety Code, Section 11173, “obtaining a controlled substance by fraud”, and two counts in violation of California Penal Code, Section 459, “commercial burglary”.

On February 5, 2008, Gordon was placed on five years formal probation and sentenced to fours years in California State Prison. The state prison sentence was stayed and Gordon was ordered to complete a one year residential drug treatment program and pay court costs and fines. Yesterday’s prison sentence was the result of Gordon’s failure to comply aforementioned the conditions of probation.

The mission of the Drug Enforcement Administration (DEA) is to enforce the controlled substances laws and regulations of the United States and bring to the criminal and civil justice system of the United States, or any other competent jurisdiction, those organizations and principal members of organizations, involved in the growing, manufacture, or distribution of controlled substances appearing in or destined for illicit traffic in the United States; and to recommend and support non-enforcement programs aimed at reducing the availability of illicit controlled substances on the domestic and international markets.
